Assessment criteria: 4.2 Evaluate areas where different regulatory frameworks may present conflicting requirements and ways to address such conflicts
- Regulatory frameworks can sometimes present conflicting requirements
- For example, we have a duty of care to ensure the safety of service users but also have a duty to ensure that they have the autonomy to make their own choices. This can result in a dilemma if an individual decides to do something that could put their safety in jeopardy
- In such situations, we should work with the individual to ensure that they fully understand the risks before making a decision
- If they still wish to continue, we should support the individual to minimise the risks as much as possible
- If there is doubt about the individual’s mental capacity, we may perform a mental; capacity assessment
- We may need support from other people, organisations or agencies, such as social services, the community nursing team or the individual’s family
