  • Legal and ethical issues can arise in relation to confidentiality because there may be times when it is appropriate to share information as a part of our duty of care
  • For example, if an individual discloses that they have been abused, we have a duty of care to share this information with the appropriate authorities so that the individual and others can be protected, even if it is against the individual’s wishes
  • For example, a court of law can issue a court order to access confidential information
  • In addition, confidential information may be shared with the consent of the individual to whom it belongs – for example, if an individual wants information about their medical condition shared with certain family members
  • It is best practice to always ask for an individual’s consent before sharing their information, however, in the cases mentioned above, information would still need to be shared with or without their consent
  • Individuals should always be informed when their information is going to be shared
